Now everything depends on the degree of risk of the economic activity of your enterprise (that is, the degree of probability of the occurrence of negative consequences from the implementation of your economic activity for human health and the environment).

The criteria for dividing business entities by risk are determined by the Cabinet of Ministers.

If for some reason the criteria for the business entity are not approved, it is considered that he has a slight degree of risk, which means that it can be checked no more than once every five years. This is precisely the situation we have today with planned inspections of SES.

The SES bodies can get the right to conduct a scheduled on-site inspection only if they notify the inspected company in writing about this no later than 10 calendar days before the day of the proposed audit. The absence of prior notice is the basis for the prohibition of auditors to check.

Unscheduled inspections are carried out depending on the sanitary and epidemiological situation, as well as according to reports of enterprises, institutions, organizations and statements of citizens. The basis for its implementation is the decision of the Chief Sanitary Inspector.

That is, with such a check they can come almost at any time, even if the previous visit of the SES workers at your enterprise was recently.

In addition, inspectors from the SES will come to the company with an unscheduled inspection when investigating the causes and conditions of the occurrence of infectious diseases, poisoning, and epidemic situations.

In addition to inspections of current economic activity, in some cases, enterprises must undergo a state sanitary and hygienic examination. (The provisional procedure for conducting state sanitary and hygienic examination was approved by order of the Ministry of Health of 09.10.2000 No. 247.)

Examination, in particular, is subject to the objects defined in Art. 11 of Law No. 4004 (existing facilities; design documentation for land plots; products and materials that could be harmful to human health), if no expertise has been conducted with respect to them and the property owner does not have a valid positive expert opinion on this property.

What are the rights of SES?

The officials of the SES bodies carrying out state sanitary and epidemiological surveillance have been given fairly broad powers. In particular, they have the right to:

  • to freely enter the territory and premises of all objects of supervision according to an official certificate;
  • establish binding instructions for the elimination of identified violations of sanitary standards;
  • to receive free of charge from legal entities and individuals materials, information, statistical and other data characterizing the sanitary and epidemic state of facilities and human health;
  • free of charge to take samples of raw materials, products, materials for the state sanitary and epidemiological examination and laboratory research.

According to clause 9 of the Regulation on Sanitary Inspection, an inspection is carried out by SES officials in the areas of the Chief State Sanitary Doctor or his deputies. Inspectors can enter the territory and premises of all objects of supervision only upon presentation of an official certificate.

Before starting the audit, SES employees must make an appropriate entry in the audit journal of the business entity (if any).

Reporting Results

The fact of violation revealed during the audit is necessarily recorded in the protocol.The basis for its preparation is the violation by the enterprise or entrepreneur of the sanitary legislation, as well as the failure to comply with decisions, orders, orders, opinions of SES officials.

If the facts of violations at the time of verification are contained in other documents (for example, the conclusions of the sanitary-hygienic examination, memoranda, statements and complaints), they are also attached to the protocol.

The protocol is executed in triplicate: one of them is handed over to the official authorized to consider the case within 3 days, the second to the offender, the third remains with the official who composed it.

Based on the results of the audit, an act of verification of compliance with sanitary legislation is mandatory. It must be drawn up no later than the last day the audit ends.

Note that this document is drawn up regardless of whether a fact of violation of sanitary legislation or failure to comply with the instructions of SES officials has been established.

Since all documents drawn up during the audit can potentially be subsequently used to decide on the application of administrative and financial sanctions, you should carefully read their contents and make sure that you have copies of them. Financial sanctions

The act of verification, the protocol on violation of sanitary standards, as well as the decision on the imposition of a fine are the basis for applying financial sanctions to violators. Administrative fines are levied in the manner prescribed by Instruction No. 64, and financial - by Order No. 135.

Questions regarding the application of sanctions are considered by state sanitary doctors and their deputies. Based on the results of consideration of a case on violation of sanitary legislation, two documents can be issued - a decision on imposing an administrative fine and a decision on the application of financial sanction.

They are made up in triplicate, one of which is necessarily handed to the violator or his representative against signature. Note that these decisions can be sent to the company by registered mail with notification.

The current legislation provides for a lot of different types of punishments that can be applied by inspectors from the SES. However, in the framework of this publication, we will focus only on the main types of fines and sanctions.

So, for violation of sanitary-hygienic and sanitary-anti-epidemic norms and rules, officials may be fined from 6 to 25 NMDG, and for citizens from 1 to 12 NMDG (Article 42 of the Code of Administrative Offenses).

For creating obstacles for SES officials in the performance of their duties, citizens face a fine of 1 to 12 NMDG, and officials - from 6 to 25 NMDG (Article 188 of the Code of Administrative Offenses).

Similar fines can be applied to business entities, which, although they allowed officials of the state sanitary and epidemiological service to be checked, did not provide them with the necessary information or provided deliberately false information.

In addition, for the production and sale of products that do not meet the standards, enterprise officials may be fined from 3 to 88 NMDG (article 167 of the Code of Administrative Offenses), and for violation of the rules for transportation or storage of products - from 3 to 40 NMDG ( Article 170 of the Code of Administrative Offenses).

In addition to administrative fines that are imposed on company officials, the current sanitary legislation also provides for the imposition of financial sanctions (see table) directly on the company or entrepreneur (Article 46 of Law No. 4004).
